Terms of sale.

These Terms of Sale apply when you buy directly from EarthMeta LTD, a company incorporated in Hong Kong (“EarthMeta”): cities minted from the Available cities catalogue, credit packs, and any other digital product EarthMeta prices and sells itself.

Purchases between users on the marketplace (a city, land or building bought from another holder) are contracts between those users. EarthMeta provides the marketplace and its smart contracts but is not the seller; the marketplace fees shown before you confirm still apply.

These terms sit alongside our Terms of Use, Privacy Policy and Risk Disclosure. If they conflict on a purchase, these Terms of Sale apply.

• You must be at least 18 years old, or the age of majority where you live if higher.
• You must not be located in, or a resident of, a country subject to comprehensive sanctions, or be on a sanctions list.
• You must use a wallet you control and be allowed to buy crypto-assets where you live.

We may ask you to verify your identity before or after a purchase, and may refuse or cancel an order where we cannot, or where the law requires it.

A city is an NFT on the Ethereum blockchain, representing a digital city in EarthMeta. Holding it gives you the Governor title and the in-platform rights attached to that city, including the Governor fee on marketplace transactions inside it, under the smart-contract rules in force.

Credits are a prepaid balance for platform features such as AI building generation and dashboard tools. They have no cash value, cannot be transferred or exchanged for money or $EMT, and are used at the rates shown in the app.

A city NFT does not give you any ownership of, or rights over, the real-world place it depicts, its name, landmarks or trademarks.

Prices are shown before you confirm, in $EMT and/or another currency. The mint price of a city depends on its tier. Any affiliate discount is applied before you pay.

You can pay in $EMT or other supported crypto-assets through our smart contracts, or by card through our third-party payment provider. EarthMeta does not receive or store your full card number.

You also pay the Ethereum network (gas) fees for your transaction. These are set by the network, not by EarthMeta, and are not refundable.

Where VAT or another sales tax applies, it is included or shown at checkout.

A city is delivered when the NFT is minted or transferred to your wallet, which normally happens once the transaction is confirmed on-chain. Credits are added to your account once payment is confirmed.

If a paid order is not delivered, contact us with your transaction hash and we will either complete the delivery or refund you.

If you are a consumer in the UK or the EU, you normally have 14 days to cancel a distance purchase. For digital content supplied immediately, that right ends once delivery starts with your express consent and your acknowledgement that you lose it. By confirming a purchase, you ask us to start delivery immediately and acknowledge that you lose your right to cancel once your city is minted or your credits are added.

Because of how blockchains work, a delivered NFT cannot be taken back by us. We therefore do not refund delivered purchases, except where the law requires it or where we made an error (for example a duplicate payment, or an item that was not delivered).

Unused credits are not refunded, except where the law requires it.

Nothing in these terms affects your statutory rights as a consumer.

EarthMeta does not promise that a city, a credit pack or $EMT will keep or increase its value, or that any Governor or Presidential fee will reach a given amount. Fees depend on marketplace activity. Please read our Risk Disclosure before buying.

If a card payment is reversed or charged back after delivery, we may suspend the related account features and recover the amount owed. Purchases made with stolen funds, or to launder money, will be cancelled where possible and reported where the law requires it.

These Terms of Sale are governed by the laws of the Hong Kong Special Administrative Region. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and can bring a claim in its courts.
