PLEASE READ THESE SITE TERMS CAREFULLY. BY ACCESSING OR USING THIS PLATFORM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS, POLICIES, AND GUIDELINES. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS PLATFORM.

EarthMeta reserves the right to change the Platform Terms at any time and at its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the Site. Your continued use of this Platform following the posting of its changes will constitute your acceptance of such changes. If you do not agree to the amended terms, you must stop using the Platform.

If you create an account on the Platform, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account.

You agree to provide and maintain accurate, current, and complete information, including your contact information for notices and other communications from us. You may not use false or misleading information in connection to your account, or trade on the name or reputation of others, and EarthMeta may change or remove any information that it considers inappropriate or unlawful, or otherwise likely to expose EarthMeta to claims of third parties. You agree that we may take steps to verify the accuracy of the information you have provided to us.

You are responsible for taking reasonable steps to maintain the confidentiality of your username and password. You must immediately notify EarthMeta of any unauthorized uses of your information, your account, or any other security breaches. EarthMeta will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

If you register for an account with EarthMeta, you will be asked to choose a user ID and password. Your user ID must not be liable to mislead and must comply with the content rules; you must not use your account or user ID for or in connection with the impersonation of any person.

You must keep your password confidential, and notify us in writing immediately if you become aware of any disclosure of your password. You are responsible for any activity on our Platform arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

Your submission of Feedback will constitute an assignment to us of all worldwide rights, titles, and interests in your Feedback, including all copyrights and other intellectual property rights in your Feedback. We will be entitled to reduce to practice, exploit, make, use, copy, disclose, display or perform publicly, distribute, improve and modify any Feedback you submit for any purpose whatsoever, without restriction and without compensating you in any way.

By submitting Feedback, however, please note that you represent and warrant that any ideas or information you include in your Feedback are not confidential or proprietary in any way, and that you have the legal right to disclose the ideas and information. For this reason, we ask that you not send us any Feedback that you do not wish to assign to us.

EarthMeta, the EarthMeta logo, and all other trademarks, service marks, graphics, and logos used in connection with the Platform, Products, and Services, are trademarks or registered trademarks of EarthMeta or EarthMeta’s licensors. Other trademarks, service marks, graphics, and logos used in connection with the Platform, Products, and Services may be the trademarks of other third parties, in which case such license is for the exclusive benefit and use of us unless otherwise stated, or may be the property of their respective owners.

Your use of the Platform grants you no right or license to reproduce or otherwise use any EarthMeta or third-party trademarks. Likewise, you grant us no right or license to reproduce or otherwise use any of your trademarks, service marks, graphics, and/or logos, unless expressly authorized by you.

We do not monitor or review the content of other parties’ websites that are linked to this Platform. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by us, and we should not be regarded as the publisher of such opinions or material. Please be aware that we are not responsible for the privacy practices, or content, of these sites.

We may also provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

We encourage our users to be aware when they leave our Platform, and to read the privacy statements of these sites.

Through our Platform, all registered users are able to make purchases and sales with peer-to-peer secure payment, as we are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology. EarthMeta does not receive, process, or store credit card numbers.

To facilitate smooth and more secure payment processes, EarthMeta accepts MATIC for all transactions made within the Platform. As stated above, we do not store or collect your payment processing details. Payment is processed on the Polygon blockchain and is provided directly through our smart contract.

The first sale of Cities is conducted by the EarthMeta team at a fair price. The Governor who acquires a City then has the power to sell it at the price they think is right, on the understanding that asset prices are subject to change at any time based on market supply and demand.

To ensure the sustainability of our project, every transaction that takes place on the EarthMeta Platform is subject to a 1.5% commission fee. Part of that 1.5% is dedicated to our charity project. In addition to the commission collected by us, each time you use a smart contract to conduct a transaction with another user you pay a small network fee, which is far lower than the equivalent on the Ethereum mainnet. Using Ethereum through the Polygon layer gives you instantly settled transactions at close to zero gas fees.

You may use the Platform only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Platform in any way that violates any applicable federal, state, local, or international law or regulation; to engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Platform, or which, as determined by us, may harm EarthMeta or users of the Platform or expose them to liability; or to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

Additionally, you agree not to use the Platform in any manner that could disable, overburden, damage, or impair the site, or interfere with any other party’s use of the Platform, including their ability to engage in real-time activities through it.

You agree not to use any robot, spider, or other automatic device, process, or means to access the Platform for any purpose, including monitoring or copying any of the material on the Platform; nor any manual process to monitor or copy material for any unauthorized purpose without our prior written consent.

You agree not to use any device, software, or routine that interferes with the proper working of the Platform, nor to introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

You agree not to attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform; nor to attack the Platform via a denial-of-service or distributed denial-of-service attack; nor otherwise attempt to interfere with its proper working.

When we consider that a breach of these terms of use has occurred, we may take such action as we deem appropriate. This may result in our taking all or any of the following actions: immediate, temporary, or permanent withdrawal of your right to use our Platform and your registration account; immediate, temporary, or permanent removal of any contribution uploaded by you to our Platform; sending you one or more formal warnings; legal proceedings against you for reimbursement of all costs on an indemnity basis, including reasonable administrative and legal costs, resulting from the breach; further legal action against you; and disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all actions we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE PLATFORM ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY.

NEITHER EARTHMETA NOR ANY OF ITS RESPECTIVE AFFILIATES NOR SUBSIDIARIES WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION, MATERIALS, OR SERVICES PROVIDED ON OR THROUGH THE PLATFORM. THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THIS PLATFORM MAY BE OUT OF DATE, AND NEITHER EARTHMETA NOR ANY OF ITS RESPECTIVE AFFILIATES OR SUBSIDIARIES MAKES ANY COMMITMENT OR ASSUMES ANY DUTY TO UPDATE SUCH INFORMATION, MATERIALS, OR SERVICES.

THE FOREGOING EXCLUSIONS OF IMPLIED WARRANTIES DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW. PLEASE REFER TO YOUR LOCAL LAWS FOR ANY SUCH PROHIBITIONS.

IN NO EVENT WILL EARTHMETA BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES FOR USE OF THIS PLATFORM INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT, BUSINESS INTERRUPTIONS, LOSS OF DATA, OR DAMAGES RESULTING FROM USE OF OR RELIANCE ON THE INFORMATION PRESENT, EVEN IF EARTHMETA IS EXPRESSLY ADVISED ABOUT THE POSSIBILITY OF SUCH DAMAGES.

IN THE EVENT OF ANY PROBLEM WITH THE PLATFORM OR ANY CONTENT THEREIN, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE PLATFORM.

YOU AGREE TO INDEMNIFY AND HOLD EARTHMETA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEY FEES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF THE PLATFORM; (B) YOUR NON-COMPLIANCE WITH OR BREACH OF THIS AGREEMENT; (C) YOUR USE OF THIRD-PARTY SERVICES, PRODUCTS, LINKS, ADVERTISEMENTS, AND/OR TOOLS; (D) YOUR VIOLATION OF ANY THIRD-PARTY RIGHTS, INCLUDING THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS; OR (E) THE UNAUTHORIZED USE OF THE PLATFORM BY ANY OTHER PERSON USING YOUR INFORMATION.

Our Service does not address anyone under the age of 13 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 13.

If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, we take steps to remove that information from our servers.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our Platform.

It is your responsibility to check our Platform periodically for changes. Your continued use of or access to our Platform or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
